State Regulations

Adolescent Tobacco Use Prevention Act (ATUPA)
In 1994, New York State made it illegal to sell tobacco products to anyone under the age of 18. The law requires tobacco product vendors to card young tobacco purchasers and display signs stating the no sales to minors' policy. Violating vendors face stiff fines and possible loss of lottery and tobacco product sales licenses. The act also prohibits the sales of loosies.

NYS Clean Indoor Air Act (Public Health Law, Article 13-E)
In 2003, the New York State Clean Indoor Air Act was amended to prohibit smoking in virtually all workplaces, including restaurants and bars. The changes in the Act reflect the state's commitment to ensuring that all workers are protected from secondhand smoke.

2004 Fire Safe Cigarette Law
New York State was the first state to enact a cigarette fire safety law which requires that all cigarettes sold in the state be self-extinguishing. The intent of the law is to prevent fires caused by burning cigarettes left unattended and particularly those held by smokers who fall asleep during use.

Internet Tobacco Sales
The sale of tobacco products over the internet is illegal in New York State.
